PART 3 — AI, NIL, and Ownership of Digital Likeness: Protecting Your Brand in a Synthetic World
As athletes, your name, image, and likeness (NIL) are your most valuable assets. With the rise of AI, the legal questions around NIL have become more complicated—and the stakes have never been higher.
Generative AI can create “digital twins” of athletes: synthetic videos, audio, avatars, or training simulations that look and sound like you. The challenge? Most of the laws, contracts, and NIL agreements drafted even just a few years ago don’t clearly address AI-created content.
1. AI and Unauthorized Likeness
AI models are often trained on publicly available images and videos — TikTok, Instagram, YouTube, highlight reels — without explicit permission from the athlete. This can result in:
Synthetic endorsements: AI-generated content that makes it appear you support or promote a product you never agreed to.
Digital avatars: Likenesses used in games, training apps, or AI-driven fan experiences.
Voice or facial replication: Deepfake audio or video used in campaigns or promotions.

This creates a gray area: the AI content may infringe on your likeness, but the law hasn’t clearly defined liability or enforceable remedies yet.
2. NIL Agreements and AI
Most NIL contracts drafted don’t explicitly reference AI. This can lead to situations where:
A brand generates synthetic content of your likeness without additional compensation.
An AI-generated endorsement goes live after your contract ends.
Disputes arise over whether a digital twin is included in “NIL rights” or “brand usage” language.
Agents and lawyers are now recommending that contracts explicitly address AI content, digital replicas, and training data usage to avoid future disputes.
3. Intellectual Property Considerations
Your image and likeness may also intersect with copyright, trademark, and licensing rights:
Training models may infringe on copyrighted game footage if used without authorization.
AI-generated avatars or voice clones may violate existing trademark or brand protections if used commercially.
If your likeness is monetized in a game, NFT, or AI-driven experience without consent, you may have claims for misappropriation or unjust enrichment.

4. Practical Steps for Athletes
Athletes can protect themselves through both legal strategy and operational safeguards:
Contract language: Include clauses that cover AI-generated likeness, digital twins, and data usage.
Rights management: Maintain control of all original media (video, audio, photos) and track where it is published.
Licensing guidance: Treat AI-generated content as a licensing opportunity, not an automatic right for brands or third parties.
Digital monitoring: Monitor social media, AI platforms, and marketplaces for unauthorized use.
Rapid takedown process: Have legal counsel and agents ready to issue DMCA or takedown notices to platforms hosting infringing AI content.
5. Why This Matters Now
With AI adoption accelerating in sports, brands, game developers, and even scammers can create highly realistic content quickly and at scale. Without proactive legal protections, athletes risk:
Losing control over how their image is used
Undermining existing NIL deals
Facing reputational or financial harm
Complicating future endorsements or partnerships
